These Terms & Conditions (“Terms”) govern your use of Zero F*cks Daily (the “Service”), operated by Deanne deRivas (“we,” “us,” or “our”). By using the Service you agree to these Terms.
1. The Service
Zero F*cks Daily is a novelty web application that generates humorous anti-affirmations. Optional paid subscriptions unlock additional content, higher usage limits, and personalization features.
2. Acceptance
By accessing or using the Service, you confirm that you are of legal age in your jurisdiction and that you accept these Terms. If you do not agree, do not use the Service.
3. Acceptable Use
You agree not to:
- use the Service in a way that violates any law or regulation;
- engage in fraud, spam, or abusive behavior;
- infringe any third party’s intellectual-property or privacy rights;
- attempt to probe, scan, scrape, reverse engineer, or interfere with the security or operation of the Service, or distribute malware.
4. Intellectual Property
The Service, including its software, branding, and content, is owned by Deanne deRivas and protected by applicable intellectual-property laws. Nothing in these Terms grants you any right in the Service other than the limited right to use it as intended.
5. Service Level
The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, timely, or error-free.
6. Payments, Billing & Cancellation
Payments, billing, taxes, and refunds are handled by our reseller Paddle (see clause 7). Subscription fees, billing cycles, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms and our Refund Policy. Subscriptions automatically renew at the end of each billing period until canceled.
7. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.
9. Suspension & Termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time.
10. Disclaimers & Liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.
11. Governing Law
These Terms are governed by the laws of the jurisdiction where Deanne deRivas is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
12. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
